In a recent case, Defendants filed Daubert motions to exclude head compression as a viable injury capable of causing brain damage. After a 3-day Daubert hearing in Canton, OH in late April, including testimony from 2 Plaintiff experts and 3 Defense experts, the Honorable Judge Forchione acknowledged the credibility of head compression causing permanent and irreversible brain damage and denied a Defendants’ Daubert motions. Judge Forchione, like many courts before him, entered an Order on June 7, 2019 finding head compression to be a “convincing, credible, and reliable” mechanism of intrapartum brain damage under the facts presented in the case. In part, the Court relied on previous Daubert challenges that the Beam Legal Team, LLC had previously won in Michigan.
