Judge Confirms Head Compression is a “convincing, credible and reliable” Cause of Brain Damage in Recent Birth Injury Case

At Beam Legal Team, LLC, we always do our best to represent the rights of the wrongfully injured, even if they can’t speak for themselves. Unborn and newly born children are extremely susceptible to injury, which is why healthcare professionals must exhibit extreme care and diligence with pregnant patients, laboring mothers and newborn infants. When mistakes occur, sadly, they can be quite severe.

In some cases, birth trauma, prolonged labor, and other issues can result from head compression—Hypoxic Ischemic Encephalopathy (HIE) from cerebral compression causing ischemic and hemorrhagic injuries or head compression. Head compression is an injury that may occur when the baby’s head is compressed during the birth process.

In a recent case, Defendants filed Daubert motions to exclude head compression as a viable injury capable of causing brain damage. After a 3-day Daubert hearing in Canton, OH in late April, including testimony from 2 Plaintiff experts and 3 Defense experts, the Honorable Judge Forchione acknowledged the credibility of head compression causing permanent and irreversible brain damage and denied a Defendants’ Daubert motions. Judge Forchione, like many courts before him, entered an Order on June 7, 2019 finding head compression to be a “convincing, credible, and reliable” mechanism of intrapartum brain damage under the facts presented in the case. In part, the Court relied on previous Daubert challenges that the Beam Legal Team, LLC had previously won in Michigan.

Our team at Beam Legal Team, LLC is glad to see another favorable outcome in a birth injury case regarding head compression and cerebral palsy brain damage.
